ONLINE STORE REGULATIONS OF THE BATIDA BRAND

www.batida.pl 


I. GENERAL PROVISIONS

  1. The seller of the goods is the company: BATIDA Sp. z o.o. with its registered office at ul. Królewska 2 lok. Nr. 1U-24, 00-065 in Warsaw, registered by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register: 0000167112, NIP: 5260213008, REGON: 006921037.
  1. At the address www.batida.pl The company BATIDA Sp. z o.o. conducts business in the retail sale of confectionery, bakery, and delicatessen products of BATIDA Sp. z o.o., aimed at consumers and entrepreneurs.
  1. Contact with the Online Store Batida(www.batida.pl) is possible via: 

from 10:00 to 17:00 (on working days) and from 10:00 to 17:00 on Saturdays and selected holidays. 

  1. All prices of the presented goods are expressed in Polish zlotys and are gross prices (including VAT). The binding price for the parties to the transaction is the price shown next to the product at the time the client places the order. Prices do not include shipping costs.
  1. Information found on the website and subpages of the Online Store Batida do not constitute an offer within the meaning of the Civil Code. 

Prices indicate the remuneration for which the seller may accept for execution order of the client. By placing an order using the mechanisms available on the website and subpages of the Online Store Batida (www.batida.pl) makes an offer to purchase a specific product under the conditions specified in the Online Store regulations Batida. 

  1. All products offered by the Online Store Batida (batida.pl) are fresh, free from physical and legal defects, and have been legally introduced to the Polish market.
  1. For all goods sold by the Online Store Batida (batida.pl) Batida Sp. z o.o. issues VAT invoices. If there is no invoice for the order, a fiscal receipt will be attached.
  1. Via the Online Store Batida, the seller provides the client with an electronic service consisting of providing the client with the ability to browse publicly available content of the Online Store Batida, which consists of textual, graphic, and audiovisual content.
  1. The seller also provides the client with an electronic service consisting of enabling the client to conclude a sales contract with the seller for products described on the Online Store pages Batida.
  1. If the client decides to create an account in the Online Store Batida, the seller also provides the client with an electronic service consisting of creating and maintaining an account in the Online Store Batida.
  1. The seller informs The buyer that the content available on the Online Store pages Batida constitute works within the meaning of the Act of February 4, 1994, on copyright and related rights, to which the copyrights belong to the Seller.

  2. The Seller informs the Customer that further dissemination of content by the Buyer without the Seller's consent, except for use within the scope of permitted personal use, constitutes a violation of the copyrights belonging to the Seller and may result in civil or criminal liability.

DEFINITIONS 

The terms used in these Terms and Conditions mean: 

  1. Consumer – a natural person performing a legal act with an entrepreneur not directly related to their business or professional activity;
  2. Customer – a natural person, legal person, or organizational unit without legal personality but with legal capacity, using the online store (batida.pl) including in particular making purchases;
  3. Seller – BATIDA Sp. z o.o. with its registered office at ul. Królewska 2 lok. No. 1U-24, 00-065 Warsaw, registered by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register KRS: 0000167112, NIP: 5260213008, REGON: 006921037. 
  4. Online Store Batida – online store Batida operated by the Seller at the address batida.pl; 
  5. Terms and Conditions – these terms of service provided by the Seller electronically within the Online Store Batida;
  6. Product – each item ordered from the Seller;
  7. Order – the Customer's declaration of intent, directly aimed at concluding Sales contracts, specifying in particular the type and quantity of products.

 

III. ORDER PLACEMENT 

  1. The person placing the order simultaneously declares that they have full legal capacity in accordance with the provisions of the Civil Code.
  1. Placing an order is equivalent to accepting these Terms and Conditions.
  1. The sale of goods is based on orders placed via the Internet. Orders are accepted 7 days a week, 24 hours a day in the Online Store. Batida via the website: batida.pl 
  1. The Customer can place an order:

-registering and thus creating an account in the Online Store Batida by visiting the website www.batida.pl(or) 

-making a purchase without registering an account in the Batida Online Store by visiting the website www.batida.plwithout the need to log in. 

  1. If the Customer decides to register, they provide their data in the form of an email address and enter a password of their choice to secure access to the account they create.
  1. To place an order, the Customer adds products to the cart using the button located on the product card: "Add to cart", "To cart" / "Checkout", "View cart" / "Your cart". This marks the end of adding products to the cart and proceeds to the order summary. By clicking the "Continue" button, the order summary is accepted and the process moves on to personal and delivery details.
  1. The cart acceptance is done by clicking the "Complete purchase" / "Proceed" button, after which the customer is redirected to the option to fill in the address details and choose the delivery method.
  2. The next step is the option to choose the delivery location (personal pickup or delivery to the specified address), the order pickup date, and the payment method.
  1. Before placing the order, the customer is asked to check the accuracy of the entire order, especially the contact details, and to accept these terms and conditions and the privacy policy.
  1. Then the customer places the order (purchase offer) by clicking the "Buy and pay" button.
  1. The customer is redirected to the Przelewy24 payment system to make the payment. 
  1. After paying for the order, a confirmation email is sent from sklep@batida.pl to the email address provided by the customer in the order.
  1. If the order is not paid, an email with a link to pay for the order via the payment system is sent from the email address sklep@batida.pl Przelewy24.
  1. The final and binding confirmation of placing an order with the obligation to fulfill it is the return message confirming the payment for the order from the Przelewy24 system.
  2. In case of payment issues (e.g., if despite making the transfer the order still appears as unpaid), please contact us by email at: sklep@batida.pl. 

IV. ORDER FULFILLMENT AND DELIVERY 

    1. Placing an order does not mean it has been accepted for fulfillment.

    2. The seller has the right to refuse to fulfill the order within 48 hours, for example due to the lack of a specified product or the inability to fulfill the order within the time specified by the customer. In the case of paid orders, the seller undertakes to refund the amount paid. immediately after informedu The above provision does not apply to orders accepted for fulfillment, i.e., those for which a sales contract has been concluded. 

    1. The seller reserves the right not to fulfill an order in which the customer provided incomplete or false information or entered information in the order comment that does not match the content of the order placed on the e-shop platform, concerning, among others: a different delivery date, a different delivery time or place, or other additional elements that may be subject to an extra charge. 

    1. Due to the short shelf life indicated in point 4 above and for the reasons stated in point VI 1. below, The customer may withdraw from the contract and cancel the order before will be accepted for fulfillment. The seller allows the possibility of canceling an order accepted for fulfillment only if the order is at a stage that allows its withdrawal. Usually it is 48 hours before the order is fulfilled.

    1. The standard order processing time is from 24 to 48 hours from the moment the funds are credited to the Seller's account, or transaction authorization in the case of electronic payments.

    1. The ordered goods can be collected personally by the customer at one of the sales points in Warsaw:

  • Batida Wola: ul. Przy Lasku 2, 01-424 Warsaw 
  • Batida Speciality, ul. Puławska 17, 02-515 Warsaw
  • Batida Speciality, Rakowiecka 43A, 02-521 Warsaw
  • Batida, Giełdowa 5, 01-211 Warsaw
  • Batida, Plac Vogla, ul. Zygmunta Vogla 62, 00-063 Warsaw 
  • Batida, Konstancin: Al. Wojska Polskiego 3 (Stara Papiernia Shopping Gallery), 05-520 Konstancin-Jeziorna 

    The customer may make changes to the order involving changing the date, delivery location, or order contents no later than 48 hours before the scheduled delivery, exclusively by message with instructions to: sklep@batida.pl

    The minimum order amount with delivery is 45 PLN gross plus delivery cost. The ordered goods can also be delivered to an address indicated by the customer within Warsaw and selected neighboring municipalities. The shipping cost is covered by the customer. The delivery cost is divided as follows:

    • Cost: 50.00 PLN – Warsaw districts: Śródmieście, Żoliborz, Wola, Targówek, Praga-Południe, Praga-Północ, Ochota, Mokotów, Włochy, Wilanów, Wesoła, Wawer, Ursynów, Ursus, Rembertów, Bielany, Białołęka, Bemowo
    • Cost: 50.00 PLN – Municipalities neighboring Warsaw: Piaseczno, Konstancin-Jeziorna, Łomianki
    • Cost: 75.00 PLN – Municipalities neighboring Warsaw: Izabelin, Piastów, Ożarów Mazowiecki, Nadarzyn, Pruszków, Józefów, Marki, Jabłonna, Czosnów, Raszyn, Stare Babice (Babice Nowe), Izabelin
    • Cost: 75.00 PLN – Municipalities neighboring Warsaw: Wiązowna, Otwock, Kobyłka, Zielonka, Wieliszew, Izabelin, Legionowo, Halinów

     

    W case of a request for delivery outside the standard delivery area, the service cost is determined individually each time for verification and approval by Batida. Batida reserves the right to refuse the order due to the delivery address, which makes delivery to the specified address within the designated time impossible. 

     

    If the delivery is not collected despite attempts by the courier, the order will wait until the end of the next day at the boutique at ul. Królewska 2 in Warsaw, from 10:00 AM to 7:00 PM.

    1. Deliveries outside Warsaw are made by agreement expressed via e-mail and submitted electronically to the e-mail address: sklep@batida.pl. Selected products may be delivered by Polish Post or an external courier. The cost of such delivery is individually determined each time and depends on the current supplier's price list, weight, and size of the product.
    1. Comments provided by the Customer in the "Comment" field will be attempted to be fulfilled by the Seller as far as possible – they cannot be treated as guaranteed services by the Seller and do not condition the fulfillment of the basic order placed by the Customer.
    1. If the Customer orders a cake with a dedication or a plaque with a dedication, BATIDA Ltd Ltd. bears no responsibility for the content contained therein. In special cases, BATIDA Sp. z about may refuse to fulfill an order with a dedication attached due to its content, without giving a reason, about which the Customer will be promptly informed. 
    1. Standard products feature manufacturer logos, graphic elements, and other decorative details that may not be visible in sample photos. Colors shown in photos may differ from prints or computer monitor displays. Please carefully verify that every product element meets your expectations – product information can be obtained by phone at: +48 692 409 395 or by email at: sklep@batida.pl.
    1. PAYMENT TERMS

    Payment for purchases can be made in the following forms: 

    -Credit card 

    -Payment card 

    -Electronic transfer

    -Klarna

    1. Electronic transactions are processed through the payment system Przelewy24. Only orders confirmed by Przelewy24 as paid or upon crediting the payment to BATIDA Sp. z o.o.'s bank account.

    V. DPD FOODS DELIVERY

    1. Delivery time
      a) Orders are delivered within 3 business days from the order placement.
      b) Orders are not fulfilled on Mondays, weekends and public holidays.

    2. Delivery conditions
      a) The cold chain is monitored to ensure product freshness.
      b) The shipment may contain goods that do not require controlled temperature.
      c) Goods must be resistant to damage caused by increased humidity and/or low temperature in refrigerated chambers.

    3. Safety
      a) Delivery is certified according to ATP and has the required Sanepid permits.
      b) The sender receives an SMS and email notification about the upcoming shipment.
      c) The courier's phone number is provided in the SMS or email message.

    4. Delivery availability
      a) Delivery availability depends on the recipient's postal code – the system automatically adjusts delivery options based on the entered code.

    5. Delivery hours
      a) The company DPD Foods delivers shipments during business hours throughout the day.
      b) It is not possible to choose a specific delivery time.

    6. Delivery costs
      a) The shipping cost outside Warsaw is 30 PLN gross.

    7. Complaints
      a) In case of receiving damaged goods, the complaint must be reported within 24 hours of receiving the shipment.
      b) The complaint report should include a photo confirming the damage and should be sent to the e-mail address: sklep@batida.pl.
      c) The complaint will be processed within 3 business daysd) Refunds for accepted complaints will be made within 21 business days.

    VI. RETURNS AND COMPLAINTS 

    Withdrawal from the sales contract. 

    1. The seller informs that, in accordance with applicable regulations, a Customer who is a consumer may withdraw from the contract without giving reasons by submitting a relevant written statement within 14 days from the date of delivery of the item, excluding the following cases described in Article 38 of the Act of May 30, 2014 on consumer rights: The right to withdraw from a contract concluded outside the business premises or at a distance does not apply to the consumer in relation to contracts: point 3) where the subject of the service is a non-prefabricated item made according to the consumer's specifications or serving to meet their individualized needs; point 4) where the subject of the service is an item liable to rapid spoilage or having a short shelf life; point 5) where the subject of the service is an item delivered in a sealed package which cannot be returned after opening due to health protection or hygiene reasons.
    1. Therefore, the Customer placing an order through batida.pl does not have the right to withdraw from the concluded contract due to the quick perishability of the products offered in the Batida Online Store, except as indicated in point IV 5 above.
    1. The seller does not accept any shipments and returns of goods by cash on delivery or postal order.
    1. In special and justified cases, it is possible to cancel the order, provided that it has not yet been produced after deduction.
    1. The order should be checked by the Client and the point of sale employee / driver / courier company employee. For this purpose, the ordered product(s) should be inspected, shown, and checked against the receipt and delivery protocol.
    2. The Seller is not responsible for errors in placing orders caused by congestion in payment platform systems and banks. However, disputes arising from the above will be resolved by the Seller amicably, aiming for the Buyer's satisfaction. 

    VII. COMPLAINTS 

    1. Before collecting the order, the Client is obliged to check it at the point of sale in the presence of a point of sale employee or in the presence of the delivery person (driver / courier company employee).
    2. In case of detecting non-compliance of the product with the contract after its receipt or delivery, the Client may submit a complaint at any point of sale by delivering the product and proof of purchase. At the same time, the Client may refuse to accept the goods.
    3. Complaint will be processed by the Seller if it was submitted immediately after detecting the non-compliance of the goods with the contract. 
    4. The complaint will be processed within 14 days from the date of its submission by the Client. BATIDA will inform the Client by e-mail or phone about the way the complaint was handled.
    5. In case of a positive complaint resolution, the refund will be made in the form of:

    -refund via the system Przelewy24 within 21 business days (or) 

    -refund by bank transfer to the Client's account (in case of electronic bank transfer payment) within 21 business days; (or) 

    -voucher for products from the Online Store Batida. Each complaint is considered individually. 

    1. Any disputes arising from the above points will be resolved by the Seller amicably, aiming for the Client's satisfaction. 

    VIII. PRODUCT DEFECTS 

    1. The Seller undertakes to deliver to the Client a product free from defects.
    1. In case the Client detects a defect, they may submit a statement on price reduction or withdrawal from the contract, unless the Seller immediately and without undue inconvenience to the Client replaces the defective item with a defect-free one.remove the defect or defects. This limitation does not apply if the Product has already been replaced or repaired by the Seller or the Seller has not fulfilled the obligation to replace the item free from defects or remove the defect.
    1. If the Client is a Consumer, they may:
    • instead of the defect removal proposed by the Seller, demand a replacement of the item free from defects (or)
    • instead of demanding a replacement of the item, demand the removal of the defect, unless bringing the item into conformity with the contract in a manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by the Seller.
    1. When assessing excessive costs, the value of the defect-free item, the type and significance of the identified defect are taken into account, as well as the inconveniences that the Consumer would face from another way of satisfaction.
    1. The reduced price should remain in proportion to the price resulting from the contract as the value of the defective item relates to the value of the item without defects.
    2. The Customer cannot withdraw from the contract if the defect is insignificant. 

    AMICABLE DISPUTE RESOLUTION 

    1. The Seller agrees to the amicable resolution of any consumer disputes.
    1. The Consumer has the option to use out-of-court methods of handling complaints and pursuing claims. Among others, the Consumer has the option to:

    1) applying to the permanent consumer arbitration court with a request to resolve a dispute arising from the concluded sales contract, 

    2) applying to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for the amicable resolution of a dispute between the Buyer and the Seller, 

    3) using the assistance of the district (municipal) consumer rights advocate or a social organization whose statutory tasks include consumer protection. 

     

    1. More detailed information about out-of-court methods of handling complaints and pursuing claims can be found by the Consumer on the website https://polubowne.uokik.gov.pl.
    1. The Consumer may also use the ODR Shop, available at http://ec.europa.eu/consumers/odr. The platform serves to resolve disputes between consumers and entrepreneurs seeking out-of-court resolution of disputes concerning contractual obligations arising from an online sales contract or service contract.

     

    1. The Seller indicates as the entity authorized to resolve the dispute out of court: the Provincial Inspectorate of Trade Inspection in Warsaw, ul. Sienkiewicza 3, 00-015 Warsaw, email address: ih_warszawa@wiih.org.pl. More information about the above entity: http://www.wiih.org.pl/.
    1. Out-of-court consumer dispute resolution shall consist of:
    • enabling the parties to reconcile their positions in order to resolve the dispute;
    • presenting the parties with a proposal to resolve the dispute;
    • the resolution of the dispute and imposing its solution on the parties.
    1. If, as a result of a complaint submitted by the Consumer, the dispute is not resolved, the Seller provides the Consumer with a statement on paper or another durable medium regarding:
    • intention to submit a request to initiate the out-of-court consumer dispute resolution procedure or consent to participate in such procedure (or)
    • refusal to participate in the out-of-court consumer dispute resolution procedure.

     

    PERSONAL DATA 

    1. According to currently applicable legal provisions on personal data protection, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, known as GDPR, and the Act of May 10, 2018 on personal data protection. 
    1. We inform you that the administrator of our Clients' personal data is BATIDA Sp. z o.o. with its registered office at ul. Królewska 2 lok. Nr. 1U-24 in Warsaw, registered in the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, KRS 0000167112, NIP (VAT) (PL) 526-021-30-08 and REGON 006921037.
    1. The entrusted personal data is used solely for the purpose of contract fulfillment and, if the Client consents by checking the appropriate box when placing an order, for informing about new products and promotions offered by BATIDA Sp. z o.o., as well as for the purpose of pursuing the legitimate interests of the administrator.
    1. The Seller, in connection with the conducted business and collected personal data of the Client, acts in accordance with the adopted Privacy Policy, available on the website www.batida.pl.
      There you will find all the information required by GDPR related to the processing of personal data by the Seller.
    1. The Seller operating the Online Store Batida uses so-called cookies, in accordance with the provisions of the Policy Cookies available on the website www.batida.pl
    1. The Seller does not is responsible for damages caused as a result of the Client providing passwords, access to the given email account, logins, and other non-public data provided for order fulfillment to third parties, or if a third party has obtained this data unlawfully (personal data theft, hacking of IT systems, hacking of the email account). 

     

    FINAL PROVISIONS 

    1. The Terms and Conditions define the rules for shopping in the Online Store Batida. Placing an order constitutes consent to all provisions and information contained in the terms and conditions.
    2. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply:
    • The Act of April 23, 1964 – Civil Code; 
    • The Act of February 16, 2007 on competition and consumer protection; 
    • The Act of September 23, 2016 on out-of-court resolution of consumer disputes; and other legal acts referred to in these Terms and Conditions. 
    1. The provisions of these Terms and Conditions may be changed by the Seller at any time. The aforementioned changes will be published on the website batida.pl, therefore, it is possible to check and print the currently applicable version at any time.
    1. The Terms and Conditions applicable at the date of contract conclusion apply to sales agreements concluded before the change of the Terms and Conditions.
    1. The Client who has a user account in the Online Store Batida, will be informed of any changes to the Terms and Conditions at the email address assigned to the user account. If the changed Terms and Conditions are not accepted, the Buyer may terminate the user account agreement with immediate effect (delete the user account) without incurring any costs.
    1. For using the Online Store Batida The Client's IT system should meet the following minimum technical requirements: 
    • Web browsers: Microsoft Edge; Mozilla Firefox; Opera; Chrome; Safari. 
    • The User should have JavaScript enabled in the browser. 
    1. From the Online Store Batida(not) allowed to use anonymously. 
    1. The Seller reserves the right to introduce temporary promotions and withdraw products from the Online Store Batida.
    1. The Client, using the Online Store Batida may not provide illegal content. The Client is obliged to use the Online Store Batida in a manner compliant with the law, good practices, and the Terms and Conditions. Prohibited are, in particular: 
    • sending via forms available in the Online Store Batida illegal content, especially offensive, racist, discriminatory content, or content inciting aggression or hatred, sexist, pornographic, 
    • using the Online Store Batida for marketing activities, especially publishing comments of an advertising, marketing, promotional, or sales nature in the Store, 
    • publishing in the Online Store Batida content infringing on others' personal rights or intellectual property rights, especially copyrights, 
    • using the Online Store Batida in a way that is burdensome to other users or the Seller, 
    • taking any actions that disrupt the proper functioning of the Online Store Batida, especially through the use of malicious software, 
    • using content available in the Online Store Batida exceeding the limits of personal use, in particular distributing this content outside the Online Store Batida, 
    • sharing access credentials to the user account with other people.

    Message frequency may vary. Consent is not a condition of purchase. If you wish to stop receiving marketing messages and text notifications, reply STOP to any text message sent by us or use the opt-out link provided in any of our messages.

    You understand and agree that alternative opt-out methods, such as using other words or phrases, will not be considered valid opt-out measures. We do not charge for the service, but you are responsible for any fees and charges associated with sending text messages imposed by your wireless service provider. Message and data rates may apply.

    We reserve the right to modify any phone number or shortcode we use to operate the service at any time. You will be notified in such cases.

    You agree that any messages sent to a phone number or shortcode that we have changed, including any STOP or HELP requests, may not be received, and we will not be responsible for fulfilling requests contained in such messages.

    To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent via the service, errors in such information, and/or for any actions you may or may not take based on that information or the service.

    2.    At the address www.batida.pl The company BATIDA Sp. z o.o. conducts business in the retail sale of confectionery, bakery, and delicatessen products of BATIDA Sp. z o.o., aimed at consumers and entrepreneurs.

    3.    Contact with the Batida Online Store(www.batida.pl) regarding arrangements related to the Program is possible via:

    5.    Information on the Batida Online Store website and subpages does not constitute an offer within the meaning of the Civil Code.

    Prices indicate the compensation at which the Seller may accept the Customer's order for fulfillment. By placing an order using the mechanisms available on the Batida Online Store website and subpages (www.batida.pl) makes an offer to purchase a specified product under the conditions given in the Batida Online Store regulations.

     

    II. DEFINITIONS

         Regulations – these terms of service provided by the Seller electronically within the Batida Online Store.

         Participant – an adult natural person with full legal capacity who has registered in the Loyalty Program under the terms described in the Regulations and accepted the terms of the Regulations.

         Account – an individual Participant account, created through the Participant's registration in the Program, necessary to take part in the Program.

         Batida Online Store – the Batida online store operated by the Seller at the address batida.pl

         Seller – BATIDA Sp. z o.o. with its registered office at ul. Królewska 2 lok. Nr. 1U-24, 00-065 Warsaw, registered by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register: 0000167112, NIP: 5260213008, REGON: 006921037

         Order – a statement of intent by the Client, directly aimed at concluding a Sales Agreement, specifying in particular the type and quantity of products.

         Points – units awarded to Participants in exchange for a specified amount spent by the Participant in the Batida Online Store on purchasing products and services from Sellers or in exchange for performing certain actions, credited during the Program period via the Batida Store website or other participation, under the terms described in these Regulations, entitling Participants to receive a Reward

         Reward – a reward due to the Participant for achieving the required number of Points to claim it, in accordance with the provisions of the Regulations.

         Reward Pickup Point – a designated Seller option, available through the Batida Online Store, where the Participant can collect Rewards or use Discounts by placing an order in the Batida Online Store

         Participation levels - levels of established titles defining the Participant's loyalty status and access to additional privileges

     

    III. REGISTRATION OF PARTICIPATION IN THE PROGRAM

     

    Participation in the Program is voluntary. To participate in the Program, it is necessary to register an Account. To create an Account, the Participant must have their own email address. The Participant is obliged to provide true data during the registration process, under the penalty of consequences provided for in § 3 sec. 7.

    A Participant may have only one Account in the Application, regardless of the number of mobile devices and email addresses they have. If irregularities are detected, the Participant's Account may be blocked and collected points deleted.

    The Participant's Account is linked to their email address regardless of the registration and login method chosen.

    IV. REWARDS AND POINT ALLOCATION

    1.    Points are credited automatically after meeting the conditions of a given activity. In cases requiring confirmation and/or system failures (e.g., sharing a post), the Participant may be asked to send proof of task completion to the email address sklep@batida.pl.

    2.    Rules for exchanging points for rewards Collected points can be exchanged for attractive rewards and discounts in the Batida Online Store. Rewards are granted according to the formula below:

         55 PLN discount on purchases – 100 points

         25 PLN discount on purchases – 50 points

    After collecting the required number of points, the Participant can redeem a discount when placing an order in the Batida Online Store. To do this, log in to your account and place an order using the online system, in accordance with the operating rules of the Batida Online Store, described in the regulations on the website https://batida.pl/

    3.    Rules for awarding points Participants in the Batida Loyalty Program can earn loyalty points for activities related to the Batida brand. Points are awarded according to the following rules:

         Following Batida on the TikTok platform – 5 points

         Following Batida on the Instagram platform – 5 points

         Sharing a Batida post on the Facebook platform – 10 points

         Batida newsletter subscription – 5 points

         Birthday bonus – 5 points

         Posting a review - 1 point

         Account registration - 3 points

         Placed order - 1 point for every 10 zł spent

         Referral rewards Participants of the Batida Loyalty Program can earn additional points by referring the program to their friends:

         A new user (invited by a Participant) receives a 15% discount on their first purchase after registering in the Program.

         A Participant who referred the program receives 10 points for each new user who makes their first purchase.

    Referral points are credited automatically after the new user completes their first order.

    4.    Participation levels The Batida Loyalty Program includes four levels+

     participation, which determine the Participant's loyalty status and access to additional privileges:

         Silver – awarded automatically upon account creation.

         Gold – achieved after earning 200 points | points multiplier x1.2

         Platinum – achieved after earning 1000 points | points multiplier x1.3

    ○ Diamond – the highest level, available after earning 2000 points | points multiplier x1.5

    5. Reward collection Rewards can only be redeemed through the Batida Online Store. Discounts are applied automatically when placing an order after reaching the required number of points.
    Rewards are not exchangeable for cash or other equivalents. Points collected within the Loyalty Program do not expire. They remain active on the Participant's account indefinitely.

    V. COMPLAINTS

    All comments and complaints regarding the Program should be submitted by email to: sklep@batida.plComplaints are handled promptly, no later than within 14 days from the date of receipt.

    VI. PERSONAL DATA PROTECTION AND PRIVACY POLICY

    The administrator of personal data processed in connection with the Program is: BATIDA Sp. z o.o. with its registered office at ul. Królewska 2 lok. Nr. 1U-24, 00-065 Warsaw, registered by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register: 0000167112, NIP: 5260213008, REGON: 006921037 (hereinafter: "Administrator").

    Personal data is processed in accordance with applicable laws, including Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: "GDPR").

     

    VII. FINAL PROVISIONS

    The Organizer reserves the right to make changes to the rewards catalog and the point awarding mechanisms. Any modification of the terms will be announced with appropriate notice on the website www.batida.pl. or via the newsletter. In matters not regulated by these terms, the provisions of Polish law shall apply:

    ● Act of April 23, 1964 – Civil Code;

    ● Act of February 16, 2007 on competition and consumer protection;

    ● Acts of September 23, 2016 on out-of-court resolution of consumer disputes; and other legal acts referenced in these Terms and Conditions.
